By ordering products through this web site or by accepting delivery of products ordered, you accept and agree to be bound by these terms and conditions. | Customer Satisfaction Guarantee. |

You may return any item purchased on our web site for any reason, within the first thirty (30) days after delivery. We'll gladly exchange your product or give you a refund for the full price of the item— whichever you prefer. No questions asked. No re-stocking fees. Your only cost for returning an item is the cost of shipping it back to us. If you would like to return an item, please email us at support@marware.com or call us at 954.927.6031 to request a Return Authorization (RA) number.
The returned merchandise must be sent back in its original packaging and returned in the same condition as when sold to you, including all packaging, parts, accessories, manuals, and documentation. The returned merchandise must be repackaged properly so that it is not damaged during shipping. The package MUST have our Return Authorization (RA) number on the return label.

| Prices, Shipping, Handling and Taxes. |

All prices do not include charges for shipping and handling, taxes, or other similar charges or fees, for which the Customer shall be responsible and which shall be separately charged on any invoice. The Customer shall be responsible for all sales, use, and other taxes associated with an order; currently, MARWARE is required to charge and withhold sales tax for delivery within the state of Florida.

| Payment. |
|
Payment shall be made by credit card, and must be received by MARWARE prior to the acceptance or shipment of Customer's order. We accept Visa, MasterCard, Discover and American Express. We do not accept COD orders.
MARWARE validates your credit card by checking your personal billing information, and thus we require you to enter the billing information as it appears on your credit card statement before we authorize your purchase. We charge your credit card when we ship the item. If we have to ship items in your order separately, more than one charge may show up on your card. When you place your order, we pre-authorize your credit card to make sure the funds are available. Please note: if you use a debit card, the pre-authorization may look like a debit on your account. We won't actually debit your account until we ship your order. If we have to cancel your order, the amount of time it takes to credit your account depends on the issuer of your card.

MARWARE provides replacement warranty with each product shipped to a Customer. Please see our Warranty section for more details about your particular warranty.
EXCEPT FOR THOSE WARRANTIES PROVIDED WITH A PRODUCT, THE PRODUCTS PURCHASED BY CUSTOMER ARE SOLD "AS IS," AND MARWARE DISCLAIMS, TO THE FULLEST EXTENT POSSIBLE UNDER APPLICABLE LAW, ANY AND ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS PURCHASED BY CUSTOMER, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

| Limitation of Liability. |

CUSTOMER'S SOLE REMEDY FOR ANY BREACH OF THESE TERMS AND CONDITIONS BY MARWARE SHALL BE A REFUND OF THE PURCHASE PRICE PAID. MARWARE’S TOTAL, AGGREGATE LIABILITY SHALL NOT IN ANY EVENT EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER FOR ANY PRODUCTS PURCHASED HEREUNDER. IN NO EVENT SHALL MARWARE BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, INCLUDING ANY DAMAGES, LOST PROFITS OR LOSS OF BUSINESS, OR FOR ANY CLAIM BY ANY THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.

| Arbitration. |

Any controversy or claim arising out of or relating to the order, purchase, delivery or return of merchandise from this web site shall be settled by final and binding arbitration held in Hollywood, Florida in accordance with the Rules for Commercial Arbitration (the "Rules") of the American Arbitration Association (the "AAA"). The arbitrator shall determine the merits of the matters in dispute in accordance with the law of the State of Florida and shall not have the power to alter, modify, amend, add to or subtract from any term or provision of these terms and conditions, nor to award damages or other remedies expressly prohibited by these terms and conditions, nor to grant injunctive relief, including interim relief, of any nature.

These terms and conditions and any orders or purchases from this web site shall be governed by the laws of the state of Florida, without regard to its conflicts of laws rules.

| Lifetime Warranty. |
|
MARWARE warrants to the original end customer of its products that its products are free from defects in material and workmanship affecting form, fit, and function. Any claim made alleging that any product fails to conform to the foregoing warranty may be made only by the end customer who purchased such product and only while such customer owns such product. MARWARE, at its option, will repair or replace any product that is determined by MARWARE to be defective.

| WHO IS PROTECTED BY THIS WARRANTY. |
|
The MARWARE warranty protects the original owner provided that the MARWARE product was purchased from an authorized dealer.
A copy of the original dated bill of sale must be presented whenever warranty service is required.

| WHAT IS COVERED BY THIS WARRANTY. |
|
Except as specified below, the MARWARE warranty covers all defects in material and workmanship. The following are NOT covered: Damage caused by accident, misuse, abuse, product modification, or neglect; damage occurring during shipment; damage from failure to follow instructions contained in the usage guide; damage resulting from the performance of repairs by someone not authorized by MARWARE; damage caused by installation of parts that do not conform to MARWARE specifications; any claims based on misrepresentations by the seller; products sold on an "as-is" or final sale basis; or the cost of installing, removing, or re-installing a part. MARWARE’S liability is limited to the repair or replacement, at our option, of any defective product and shall not include incidental or consequential damages. MARWARE reserves the right to replace a discontinued model with a comparable model. Any replacement units or parts may be new or rebuilt.

If the product was purchased outside of the United States, please contact MARWARE for details on warranty service.
Do not return products without authorization. They will be returned unopened. You are responsible for transporting your product for repair or replacement.

You are responsible for transporting your product for repair or replacement. MARWARE will pay reasonable return charges for delivery to any location in the United States if the repair or replacement is covered under this warranty.
